BIR FILING TRAP

If you're involved in RE transactions, take note. A relatively recent change in the BIR's filing process for Capital Gains Tax (CGT) and Documentary Stamp Tax (DST) can create unexpected delays and expose taxpayers to penalties.
The Old Process
1. Accomplish the CGT and DST forms using the offline eBIRForms application or by encoding the PDF forms.
2. Print the forms.
3. Pay at the bank.
There was no need to wait for any electronic confirmation before payment.
The New Process
Today, tax returns must first be electronically submitted through eBIRForms before payment can be made.
After submitting the return, you must wait for the BIR's email confirmation acknowledging receipt of the filing. Banks are now commonly requiring a printed copy of this confirmation email before accepting payment.
Why This Matters
Based on discussions with our liaison team, the confirmation email isn't generated real time. In some cases, it may take several business days to arrive. That creates a practical problem.
In the past, taxpayers could make "voluntary payments"—preparing the tax return and paying it immediately, even before getting an ONETT. The new process effectively removes that flexibility because payment now depends on first receiving the electronic filing confirmation.
Here's an Example
Imagine a sale closes on the afternoon of July 31 (Friday).
For DST, the deadline is August 5 (5th of the following month).
If you electronically file on August 3 (Monday) but the confirmation email is delayed, you may find yourself running dangerously close to—or even beyond—the deadline.
To make matters worse, operational issues can arise as well. Just recently, a bank was unable to accept tax payments for 2 consecutive days because its system was offline. Delays like these can quickly consume the already narrow filing window.
Takeaway
Avoid scheduling closings during the last few days of the month.
Closing earlier provides a buffer for electronic filing delays and significantly reduces the risk of incurring unnecessary penalties simply because the confirmation email arrived late.
